Cornerstones of national human rights protection mechanisms, Human Rights Commissions and similar institutions find their official international recognition through accreditation by the International Coordinating Committee of National Human Rights Institutions (ICC) working under the auspices of the OHCHR. To receive the accreditation of National Human Rights Institution (NHRI) these Commissions have to be assessed as being in compliance with an agreed set of norms commonly referred to as the Paris Principles.
The adoption of Law nº 33/2009 on 22 December 2009, considered to a large extent Paris-Principles-compliant, created the Comissão Nacional dos Direitos Humanos(hereinafter CNDH) with a mandate to:
With the entering into force of the Law in April 2010, the Ministry of Justice was mandated to work on establishing the CNDH and making it operational. All 11 Commissioners were selected in 2012 and have taken oath on 05 September 2012. Since that date the CNDH is considered as officially established and is facing the hard challenge of becoming operational. Upon appointment of the Commissioners, UNDP has in the last part opf 2012 engaged in activities aimed at making the Commission operational by providing (jointly with the OHCHR) an induction training, by supporting a needs assessment study from an International expert, and by supporting the drafting by the members of the Commission of an activity plan for 2013. The National Human Rights Commission is now at a critical stage of having to draft a multi-year strategic plan that will cover the period 2014-2018. This document will guide the process of making the services of the Commission actually available to the Citizens of Mozambique. By using comparative experiences of other Institutions that have engaged in similar endeavours and placing them into the specific scenario of Mozambique the CNDH has set a target date of September 2012 to finalize the plan and present it to all relevant stakeholders. Lacking capacity and expertise to draft alone such an important document the Chairperson of the CNDH has requested the support of UNDP to hire a team of consultants that would facilitate and support the drafting process. This particular ToR focus on the services required by the national Consultant. Those related to the international expert will be drafted in a separate submission. | |
Duties and Responsibilities | |
A home-based thorough study of:
Conduct research work in team with the international expert. The national consultant will conduct interviews with all relevant stakeholders and visit at least one Province outside Maputo. During the last week of the assignment, facilitate a workshop which will involve members of the CNDH and other relevant stakeholders in order to agree on a basic structure and guiding principles of the Strategic Plan. Elaborate the Strategic Plan for the NCHR in Mozambique jointly with the international consultant, the Chair, Administrative Secretariat and the Commissioners of the CNDH. Communicate regularly with the National Consultant and by 30 June 2013 submit the first draft of the Strategic Plan to the National Human Rights Commission. In the month of July engage with Members of the National Human Rights Commission with the aim of submitting a final draft document by August 15 2013. Participate in the month of September for the presentation of the Strategic Plan of the National Human Rights Commission. Submit a separate report to UNDP by 30 September 2013 on the outcome and impressions of the Consultancy work with recommendations and suggestions on follow up activities necessary for the implementation of the Strategic Plan.
