The Ministry of Trade and Industry has received financing from the World Bank toward the cost of the Government for Competitive Technical Assistance Project, and intends to apply part of the proceeds for the recruitment of an individual legal consultant to assist with the legal registration of associations and chambers.
The consulting services ("the Services") include: The Private Sector Federation (PSF) mission is to advocate effectively and reinforce members' businesses. Since inception in 1999, PSF has matured into the apex organization representing the business community in Rwanda. The Federation stands ready to lead Rwanda's quest for prosperity through a real collaboration with the public sector and other stakeholders (development partners) on private sector development.
To deliver on its mandate, the Federation has concluded a strategic operating plan that positions it to serve as a key architect in Rwanda's quest for prosperity.
As envisioned in its strategy, strengthening and empowering associations and chambers is one of the priorities of PSF in order to bring services to the members at the grassroots level. Those associations and chambers have to be legally registered and governed by Rwandan law relating to professional and employer organizations.
The overall objective of the assignment: with the assistance of The World Bank –Governance for competitiveness project, PSF would like to recruit an individual legal consultant to assist with the legalization of 20 associations and 5 chambers by reviewing and updating the existing legal documents of these chambers and help them get all required documents and procedures for obtaining the legal registration (Publication in official gazette).
The specific objectives are the following:
• To draft, review and develop statutes of 20 association and 5 chambers;
• To assist in statutes approval by members;
• To follow up the process of registration from the notary services, ministry level (MIFOTRA) until the statute is published in the official gazette;
The scope of this assignment calls for competencies of the legal consultant to facilitate 20 associations and 5 chambers to be legally registered no later than 3 months.
SPECIFIC TASKS
A legal consultant will work closely with the head of membership coordination services within Private Sector Federation. He/she has a role to ensure successful legal registration and operations of those afore-mentioned chambers and associations
This overarching role broken down into the following responsibilities:
• To organize and conduct consultative meetings with key stakeholders of association and chambers for elaborating statutes and other documents required for the registration (procès verbal for elections, General assembly's minutes.)
• Liaise with MIFOTRA team in charge of legal registration of professional organizations and provide legal advice to the chambers and associations in terms of fulfilling the requirements to be legally registered as a professional organization under the law No. 13/2009 of 27 May 2009 regulating labour in Rwanda.
• Coordination of the notification of all the above mentioned statutes
• Follow up the adoption of the above statutes by MIFOTRA
• Follow up the publication of the statutes in the official gazette
REPORTING ARRANGEMENTS
The legal consultant will report directly to the Head of membership coordination services–PSF.
DURATION OF THE CONSULTANCY
The contract for this assignment will run for 4 months.
CAPACITY BUILDING AND TRANSFER OF KNOWLEDGE
During the course of the assignment and in line with the Private Sector Federation requirements to ensure transfer of sustainable capacity from all technical assistance, the consultant shall work closely with PSF team (Head of Membership coordination services, chamber directors and association secretaries) to ensure transfer of knowledge and skills.
