The Capital Markets and Securities Authority is an independent Government Agency established under the CMS Act No.5 of 1994 for the purpose of designing and implementing purposeful measures which will enable the creation and development of sustainable capital markets that are efficient, transparent, orderly, fair and equitable to all.
To increase its capability to effectively carry out its mandate, the Capital Markets and Securities Authority is seeking to engage self motivated, competent, and qualified Tanzanian citizens to fill the following vacant positions: .
Director of Legal Affairs and Enforcement
Organisational Relationship
Appointed by: The Board of Directors
Reports to: Chief Executive Officer
Supervises: Legal, Licensing and Enforcement Managers
Entry Qualifications
Holder of a Bachelors Degree in Law and a Masters Degree in either Commercial Law, Securities Law or
Business Administration and registered as an advocate of the High Court of Tanzania with twelve years
work experience, of which five years must be in a senior managerial position in a reputable institution.
Duties and Responsibilities
The attainment of the overall objective shall include-but not limited to the following:
To head the Directorate of Legal Affairs and Enforcement
To formulate rules and regulations for the purposes of regulating the activities of Capital Markets and Securities Authority
To handle legal issues on the securities industry matters relating to international and regional cooperation/ integration
Disseminating information on securities industry regulatory issues to the public and other relevant bodies within and outside the country.
Keeping abreast of, and reviewing related laws of the country and proposing amendments to the Capital
Markets and Securities Legislation,
Providing legal advice to the Capital Markets and Securities Authority,
Taking part in research projects on legal and other pertinent issues relating to the securities industry for the purposes of creating an enabling environment for the orderly growth and development of the Capital Market and Securities industry in Tanzania,
To represent the CMSA in Courts of Law, arranging for Board meetings and making follow up on implementation of the Board's decisions ,
Evaluating applications for licencing or registration of capital markets intermediaries
Evaluating and reviewing prospectus of entities applying for approval to issue securities to the public and applications for establishment of Collective Investment Scheme, mergers, acquisitions and take overs
Performing any other duties as will be assigned by the Chief Executive Officer.
