Governance and Rule of Law Expert

Burundi continues to suffer from significant rule of law deficits and reoccurring reports of politically motivated violence underline the continuing risks of fragility. This is manifested by a judiciary plagued by insufficiency of capacities and a security sector that is only partially trained and equipped to fulfill its functions, with limited civilian implication in security matters. The circulation of SALW (Small Arms and Light Weapons) and easy access to SALW continues to aggravate the risk of violence caused by criminality, land disputes or SGBV. Furthermore, on-going tensions and conflicts between political parties at the national level have an impact on security at the community level. This general background translates into a set of concrete challenges in both the justice and the security sector.
Based on its experience working with the justice and security institutions as well as civil society actors and responding to the current needs defined by the existing strategies of the government in this area, UNDP follows a multi-layered approach that targets the institutional level through work with Ministerial departments. Complementing this, a strong focus is put on strengthening the functioning of the justice and security systems at the provincial and local level in order to capitalize on previous interventions. This aims at increasing the quality and quantity of the legal and security-related services that the population of Burundi can access, i.e. through legal aid, improved functioning of the courts.
Governance and Rule of Law project will provide support to the Justice, security and gender. Under this project, assistance will be provided for institutional development and capacity to the Rule of Law, security and gender to ensure effective security service. The project will support more specifically the activities under the project to strengthen the judicial system to ensure efficient and equitable and accessible to all independent judiciary, strengthening the capacity of national structures in charge of prevention and the provision of responses to gender-based violence and strengthening community safety and the reduction of armed violence SALW control, support for the local police and the local administration. 
Under the guidance and overall supervision of the Deputy Country Director, Programme and in close collaboration and coordination with the Chief of Unit, Governance and Rule of Law, the Expert will provide strategic advice and direction to implementations of a multi-year strengthening Rule of Law Project.

Duties and Responsibilities

Project Overall Direction:
  • Oversee the project implementation management functions, provide technical advice and quality assurance on the work of the implementing partners , monitoring and evaluation and report functions;
  • Coordinate the overall delivery of the project in an effective and efficient manner; working closely with the Justice and security institutions;
  • Provide strategic direction and leadership on the Rule of Law project;
  • Support the Country Office with the implementation and reporting of projects within UNDP’s RoL(Rule of Law) portfolio, and managing the Rule of Law portfolio;
  • Support the Country Office with the planning and conceptualization of justice activities in the framework of the ongoing Rule of Law programme;
  • Liaise closely with colleagues at country office and technical teams;
  • Prepare periodic reports in and out of ATLAS and contribute to the preparation of other documentation as required;
  • Assist the Country Office in the development, negotiation and implementation of any additional initiatives elaborated in the context of the portfolio’s area of intervention;
  • Liaise with national counterparts and donors on project implementation;
  • Engage actively with BNUB (United Nations Office in Burundi) and other partners on joint planning and implementation of RoL interventions;
  • Provide support in developing new partnerships between UNDP and stakeholders – including national authorities, UN agencies, community leaders, community-based organizations, local and international NGOs, donor partners to support capacity building in the of RoL(Rule of Law), including SALW control;
  • When required, ensure the representation/leadership of UNDP in inter-agency working group meetings or other coordination mechanisms on Rule of Law;
  • Undertake any other activities as designated by the CO management as needed;
  • Liaise with implementing partners in the four northern provinces of UNDP’s focus area on a regular basis and provide technical guidance as needed, and support capacity building activities with the justice system and local civil societies.
Knowledge Management and Policy Development:
  • Identify sources of information related to policy-driven issues;
  • Identify and document best practices and lessons learnt directly linked to Rule of Law and Access to Justice programming in and in particular in Burundi;
  • Contribute to UNDP global knowledge networks and communities of practice;
  • Provide intellectual and conceptual contribution in the ROL and security Knowledge Management and Learning Strategy;
  • Collaboration and coordination with other UN agencies, government agencies, NGOs, and other organizations Rule of Law and Security issues.
Partnerships and Resource Mobilization:
  • Develop and implement partnership and resource mobilization strategy in this area. Lead and coordinate resource mobilization efforts of the project. In this regard identify funding opportunities and lead project resource mobilization efforts with donor partners, including the development of advocacy/communication tools in support of resource mobilization;
  • Ensure coherence, complementarities and coordination with other development partners in the area of rule of law, access to justice and security;
  • Advocate for and substantially contribute to One UN approach and multi-partner joint planning and/or programming initiatives;
  • Build partnerships with national and international NGOs throughout the project implementation;
  • Manage, monitor and report on financial resources allocated to and delivered by the project to contributing partners such as UNDP/BCPR and Donors;
  • Maintain regular communication with UNDP/BCPR’s Rule of Law, to enhance advocacy, support resource mobilization and access technical expertise.

    Required Skills and Experience

    Education:
    • A Master degree in law, preferably with specialization in human rights and/or international criminal law, or related relevant field. A relevant combination of university degree, professional training and experience ( at least 9 years ) may be considered in lieu of the advanced degree.
    Expérience:
    • At least 7 years’ work experience dealing with issues related to rule of law, access to justice, judicial reform and security sector reform, community security in conflict and post-conflict countries or similarly relevant experience; 
    • Prior experience within the United Nations, in particular UNDP, and UNDP Certification programmes Prince2 are desirable;
    • Experience in the usage of computers and office software packages, experience in handling of web based management systems.
    Language:
    • Excellent oral and written skills in French, and fluency in English are essential.
