Context: Under the overall guidance and supervision of the Legal Counsel and the direct supervision of the Legal Officer, the successful candidate will be accountable and responsible for providing legal advice, recommendations and services related to the legal status, constitution, functions, rules, activities of the Organization.
Core functions/ responsibilities: 1. Prepare responses to inquiries related to the interpretation and application of the Staff Regulations and Rules and IOM official Instructions, as well as personnel-related questions generally. Page 1 / 3
2. Review allegations of misconduct, advise whether cases should be pursued as disciplinary cases and, in such cases, provide advice on the appropriate procedure. 3. Conduct research on the jurisprudence of the ILO Administrative Tribunal (ILOAT), identifying trends and systemic issues, and assist in developing appropriate recommendations to senior management to address them. 4. Provide legal advice on staff grievances and, where appropriate, advise on means to informally resolve such cases. 5. Assist in negotiating settlements between staff members and the Administration. 6. Prepare the Administration's submissions for staff appeals to the Joint Administrative Review Board (JARB) and the ILOAT. 7. Review IOM official Instructions, particularly those involving personnel and insurance issues. 8. Advise individual IOM missions on privileges and immunities, particularly concerning complaints brought by IOM staff members under local labour law systems and attempts by local authorities to detain or subpoena staff members. 9. Review contracts and agreements between IOM and other parties such as donors, implementation partners, service providers, etc. 10. Attend internal and external meetings and conferences relevant to the Office of Legal Affairs. 11. Provide general legal advice as necessary on issues relating to the functions, structure, activities, and legal status of IOM. 12. Perform such other duties as may be assigned.

Desirable Qualifications and Experience a) completed Master's degree from an accredited academic institution in International Law,
* five years of professional legal experience, with at least two in the practice of law in an international organization, with substantial experience in international, administrative civil and commercial law;
* previous experience advising on human resources, staff appeals and staff insurance matters/ issues;
* developed research skills and knowledge of ILOAT jurisprudence and/or the staff conditions of service under the UN common system an advantage;
* previous experience with privileges and immunities of intergovernmental organizations as they relate to claims brought under local labour law and detention/subpoena of staff an advantage;
* previous experience or training in undertaking or advising on investigations involving misconduct (e.g. harassment, fraud, etc.) an advantage.
