TERMS OF REFERENCE FOR THE RECRUITMENT OF A TECHNICAL ASSISTANT
1.0 Introduction
The East African Community (EAC), has received a grant from the African Development Fund towards the cost of capacity building through the establishment of a Projects Implementation Unit (PIU) to spearhead the development pf regional railways programmes. EAC intends to apply part of the proceeds of this grant to eligible payments under the contract to recruit a qualified professional as an individual consultant, for the initial establishment of the PIU.
2.0 Objectives and Rationale
The East African Railways Master Plan has recommended that in order to revitalize and modernize the East African Railways, institutions need to be set up that will ensure a well structured system of achieving the objectives. The creation of an integrated rail area entails putting in place monitored common technical regulations. Given the difficulties encountered by Partner States in developing the regional railways network as an integrated system, it is necessary to create a Railways Unit at the Secretariat, initially to be run by an expert. The main objective of the Unit will be to provide the Secretariat and the PartnerStates with technical and institutional support in order to enhance the level of integration of the EAC rail system.
The Unit will also supervise consultants who will be carrying out studies identified in the Master Plan and others identified by the EAC. It will also provide advisory services to the Secretariat and EAC policy organs on decisions to be made regarding railways programmes. The Unit will also facilitate communication between the various competent national authorities
3.0 Scope of the Consultancy Services
It is envisaged that the Unit, to be staffed initially by an internationally procured Railways Expert, will carry out the following functions, among others:
(i) Develop terms of reference for consultancy services for the unpacking of the Master Plan and other studies
(ii) Develop proposals for mobilization of funds to support the consultancies that will be commissioned by the Secretariat and for reconstruction projects for existing railways
(iii) Develop proposals for the harmonization of existing railways regulations
(iv) Advise the Secretariat on the implementation of detailed feasibility studies required to determine the traffic potential in relation to proposed new railway links.
(v) Liaise with continental and sub-regional bodies working on railways interconnectivity projects and advice the EAC on best options
(vi) Advice the EAC and PartnerStates on technical issues on railways development including design standards, track gauge, electrical traction, among others.
(vii) Identify existing rules, regulations, and policies that could act as barriers to improved cross-border transport flow and /or inhibit sub-regional trade integration and recommend options and institutional/regulatory/legal framework for successful implementation of the railway master plan and for further reform in railway operations and management
(viii) Propose specific programs and projects for improving the regulatory/legal/institutional environment for efficient railway traffic movements across borders.
(ix) Oversee the development of a model railways concession agreement in conjunction with COMESA and SADC Secretariats
(x) Advice the EAC countries on how to adopt a uniform approach to international bodies, with specific roles for continental bodies, regional bodies, corridor committees and national governments
(xi) Develop a regional Public Private Partnership framework that would guide the private sector involvement in railways development
(xi) Manage the process of establishing an EAC Railways Regulatory Authority which will be responsible for oversight of concessions to ensure adherence to contractual obligations, setting up safety standards, defining tariff levels, ensuring fair competition and granting operating licenses.
4.0 Expected outputs/deliverables
1. Monthly technical progress reports for the projects components
2. Monthly financial progress reports for the projects components
3. Quarterly and Annual project performance reports
4. Terms of Reference (TOR) for the identified project sub-components
5. Request for Proposal (RFP) documents for the identified project sub-components
5.0 Duration of Engagement
The Consultant shall commence provision of services within 30 calendar days of the effective date of the contact. The effective date shall be the date of signature of consultancy contract agreement and completed within twenty four (24)calendar months from the date of the commencement of services.
6.0 Qualifications of the Consultant
The attributes of the expert and the duties to be assigned would be any of the following:
1. Railways Engineer
A qualified Civil Engineer who has specialized in Railways Engineering and possesses at least 15 years postgraduate experience in the fields of Railway Design (including computer aided design methods), Traffic Engineering, Engineering Cost Estimation, Contract documentation, Contract Management (including construction supervision) and project procurement.
He or she should be able to advise the Client on all aspects of the project implementation, especially with regard to interpretation of recommendations made by consultants in
feasibility studies and design reports and will also follow up on recommendations from the consultants reports.

2. Transport Economist
This will be a holder of an Economics degree and preferably a postgraduate diploma or masters in Transport or Development Economics with at least 15 years experience. He/She will be highly experienced in the fields of Railway Planning, Development of EIRRs for railway projects, Feasibility Studies and Traffic and Freight forecasting. He/she will be conversant with the latest computer simulation models that will help predict traffic on the EAC railways network.
7.0 Data, Services and Facilities
(a) To be provided by the Client
(i) The employer/client through Partner States will provide liaison with the Government
Ministries and Departments, Cities, town and District Councils in order to introduce the consultant to them.
(ii) (ii) The employer/client through Partner States will make available the
documentations relevant to the assignment, that have been carried out by or for the
Employer and any other relevant data available in Government Ministries and
Departments, Cities, town and District Councils, which are necessary for the proper
execution of the assignment under the contract.
(iii) The employer/client will make available office accommodation, communication, per diem allowance at EAC rates, transport facility and secretarial services, related to the performance of the works.
The Employer/Client will assist the Consultant to:
(i) Obtain formal consent from outside authorities or persons having rights or powers in connection with the assignment,
(ii) Obtain ministerial orders, sanctions, licenses and permits in connection with the works,
(iii) Register with the appropriate professional boards in Member states. Any associated fees or costs will be borne by the consultant.
(b) To be provided by the Consultant
(i) The Consultant shall be responsible for arranging all necessary living accommodation, transportation.
(ii) The consultant shall be responsible for the printing of all reports, drawings, map, etc.
(iii) All reports and documents relevant to the project, maps, field survey notes, computer programs and electronic data, etc. shall become the property of the East African Community. The Consultant shall provide the originals of maps, plans and all drawings with final documents.
8.0 Payment Terms to the Consultant
8.1 The Consultant shall quote the cost of his/her monthly remuneration and other costs as he/she deems to be required. He /she shall summarize his/her total costs.
8.2 The costs shall be quoted to cover the Consultant’s performance of his/her duties described in paragraph 3 in accordance with the following:
(a) Remuneration, subsistence and allowances
(b) Transportation
(c) Local travel expenses
(d) Shipment of personal effects etc;
(e) Insurance and medical; and
(f) Other costs which must be specified by the Consultant.
8.3 Payments will be made for undertaking the assignments described in these Terms of Reference to cover personal remuneration and reimbursables
8.4 The remuneration will remain fixed for the whole of the Contract duration
8.5 Reimbursable will be made against submission of acceptable documentary evidence
8.6 No other payments will be made to the Consultant under this contract
9.0 General Obligation
The Consultant’s remuneration shall be deemed to cover his liabilities, travel costs, medical expenses and support for his/her family and all his obligations other than additional services not covered by these terms of reference.
