General information
The Criminal Law Section is mandated to assist member countries of the Commonwealth to develop and effectively implement laws and programmes to combat all forms of criminality, in particular transnational organised crime, corruption, terrorism and international crime. This includes assisting member countries to build capacity within criminal justice systems, in order to facilitate the rule of law; promoting international co-operation between states to combat international crime and assisting states to implement international obligations and standards in domestic law. The Section also assists with the strengthening of the enforcement, prosecution and adjudication systems of member countries to ensure an effective regime for the delivery of criminal justice. The members of the Section perform a range of representational and information dissemination functions and organise training courses, conferences and workshops on various subjects in different parts of the Commonwealth.
Job summary
The temporary project based Legal Consultant will provide support and assistance to the Head of Section and work as a member of the team to deliver project based work under the Section’s mandates. This includes designing and developing projects, drafting all relevant project and budgetary documents, developing and updating resource material, assisting as required, with work in relation to the Commonwealth Schemes, requests for advice on legal and policy issues and the delivery of technical assistance and capacity building training courses and relevant programmes.
Task description
The post-holder, working under the direction and supervision of the Head of Section and in co-operation with other members of the Section and the Secretariat as appropriate is expected to provide direct assistance and support to the Head of Section, by contributing to the substantive preparation and delivery of the underlying project based activities, within the mandates set by Commonwealth Heads of Government and Law Ministers.
The post-holder will in accordance with this focus assist in the delivery of the Section’s mandates by undertaking a number of project based tasks as directed, including:
- Work related to the Section’s International Co-operation and Anti-money laundering and countering the financing of terrorism mandates.
- Design and develop project proposals (including budgets) and contribute to the related capacity building and technical assistance activities of the Section by developing and delivering as required, resource/training material on international and transnational crime mandates. (i.e mutual legal assistance, extradition, money laundering, terrorist financing, preventive measures and proceeds of crime, asset recovery, forfeiture etc.) This could also include developing as necessary model guidelines and model legislation.
- Prepare briefings and advice as required in relation to internal and external requests for advice on legal issues relevant to the Section’s mandates.
- Undertake legal research as required and develop and draft all related legal and non-legal documents as well as budgets required under the project work.
