For initial appointment, the Court offers a two-year appointment with the possibility of extension (six months probationary period). Entry on duty date is to be determined.
A roster of suitable candidates may be established for this post as a result of this selection process for both fixed-term established and general temporary assistance posts.
Duties & Responsibilities
Under the direct supervision of the Deputy Prosecutor, the incumbent heads the Appeals Section in the Prosecution Division of the Office of the Prosecutor. The incumbent will perform the following tasks:
(a) establishes procedures and guidelines regarding appellate practices, for example:
(i) what are the considerations relevant as to whether to appeal;
(ii) what constitutes an error of law, error of fact and procedural error;
(iii) the handling of interlocutory appeals; and
(iv) record and file maintenance in the Appeals Section;
(c) advises the Prosecutor on whether to appeal;
(d) responsible for pre-appeal proceedings (for example
(i) pre-appeal motions;
(ii) consideration and systematic search for any exculpatory evidence received post judgement;
(iii) response to motions to admit additional evidence);
(e) responsible for the preparation and drafting of written pleadings;
(f) normally lead counsel in oral hearings in cases before the Appeals Chamber;
(g) evaluates work of junior counsel, provides advice and guidance;
(h) manages the Appeals Section; and
(i) works closely with the Prosecution Coordinator to ensure consistency of positions and to develop positions on legal questions such as elements of crime, jurisdiction of the Court or other issues which will be common to all trials and appeals;
(j) ensures proper cooperation and coordination of tasks between the Appeals Section and the Legal Advisory Section.
Essential Qualifications
(a) Advanced degree in law from a recognised university;
(b) at least 10 years of relevant working experience (12 years with a first level university degree), preferably in large-scale criminal litigation or related work, either prosecution or defence, several years of which should be in appellate practice (drafting written briefs to appellate courts and appearing as lead counsel on criminal appeals);
(c) outstanding oral advocacy and drafting skills;
(d) strong analytical and computer skills;
(e) Sound judgement in applying legal expertise to sensitive, complex legal issues;
(f) demonstrated ability to work with and manage effectively and constructively, teams comprising both senior and junior staff, from a broad variety of disciplinary backgrounds, legal systems and professions;
(g) Excellent planning and organizational skills; ability to work under pressure of time and urgent deadlines;
(h) demonstrated ability to work effectively and constructively in a team environment and with Office member from different criminal justice systems.
(i) ability to work in a non-discriminatory manner, with respect for diversity;
(j) professional and personal integrity.
KNOWLEDGE OF LANGUAGES
Proficiency in one of the working languages of the Court, English or French, is required. Working knowledge of the other working language is preferable. Knowledge of another official language of the Court (Arabic, Chinese, Russian and Spanish) would be considered as an additional asset.
