Informal reporting line to 4 other Senior IP Counsel on issues in Africa that relate to the brands/innovation for which the Senior IP Counsel are primary counsel
Based in London. The role will require overseas travel.
Dimensions of the role
a) Financial
There is no formal budget responsibility, but a general requirement to provide support in a commercial and cost-effective manner.
b) Market Complexity
Supporting markets in Africa territories where the IP laws may differ significantly from GB laws.
Supporting markets in Africa where Diageo’s presence is through complex JV arrangements where the JV entities hold local brands in addition to Diageo brands.
Supporting the Global Travel business which operates in a large number of territories.
c) Leadership Responsibilities
Effectively assume the leadership role as the line manager of one paralegal and be able to delegate efficiently and coach them to achieve the highest levels of performance.
Purpose of Role
To prepare and deliver high quality, commercially astute intellectual property (“IP”) legal services to Diageo, and in particular to:
the Africa marketing and innovation teams (based in 7HQ), the Africa in-market companies and JVs, the Diageo and JV regional counsel in Africa, to help them provide a seamless legal service to the in-market companies and JVs; and the Diageo GTME teams
Qualifications and experience required
Excellent knowledge of trade mark, design and copyright (and good working knowledge of patent and trade secret protection and other IP areas) essential.
Significant experience in handling enforcement matters such as co-ordination of investigations, cease & desist letters and other pre-litigation enforcement measures; experience in managing all aspects of trade mark and other IP litigation.
Significant experience in drafting and negotiating IP related documents, such as licences, assignments and co-existence agreements etc.
Experience in management of trade mark opposition, cancellation, and other conflict matters.
Knowledge of internet and domain name registration and enforcement programs preferred.
Experience of IP aspects of M&A transactions desirable.
Experience in educating a commercial business on IP highly desirable
Ability to work with minimal supervision.
The ability to identify IP legal and commercial issues and propose practical and efficient strategies to address them.
The ability to express complex IP legal concepts and opinions in a clear, practical and commercial manner.
Excellent interpersonal communication and presentation skills.
Ability to challenge key senior stakeholders, edge.
Experience in managing client relationships and management of third parties.
