Org. Setting and Reporting

The post is located in the Office of the Prosecutor (OTP), Appeals and Legal Advisory

Division (ALAD). The incumbent will work under the direct supervision of a Senior Appeals Counsel and the general supervision of the Chief of ALAD

Responsibilities

Under the supervision of a Senior Appeals Counsel, the incumbent shall perform the following duties:

-Co-ordinate the handling of appeals on behalf of the Prosecutor before the Appeals Chamber and, as a team leader, co-ordinate the provision of legal advice to trial teams and senior managements in OTP;

-Handle a wide range of complex, multi-disciplinary issues, relating to matters of substantive international and national criminal law, evidence, and procedure;

-Review and analyze final judgments and interlocutory decisions of Trial Chambers and provide advice on advisability and grounds of appeal;

-Draft notices of appeal or requests for certification to appeal and appeal briefs on behalf of the Prosecutor in post trial judgment and interlocutory appeals;

-Conduct legal research and writing, review trial records, and conduct database searches, in relation to the preparation of appeal briefs and the handling of pre-appeal motions and in order to provide legal advice to trial teams;

-Provide legal advice to trial teams on a range of issues, relating to substantive law, procedure, evidence, disclosure, ethics, and trial strategy and tactics;

-Handle various pre-appeal motions on behalf of the Prosecutor;

-Appear as lead counsel for the Prosecutor at hearings before the Appeals Chamber;

-Assist the Senior Appeals Counsel in preparing for oral argument in appeals, attend in court as co-counsel with the Senior Appeals Counsel before the Appeals Chamber;

-Ensure compliance with orders or directives of the Appeals Chamber, and make oral submissions at appeal hearings or related proceedings;

-Serve as mentor to other appellate counsel and legal interns assigned to appeals;

-Assist in the preparation and delivery of in-house legal training within OTP; and

-Discharge promptly and competently any other tasks assigned.

Results expected: Handle a wide range of complex, multi-disciplinary issues relating to matters of management, policy, advocacy, substantive international and national criminal law, evidence, procedure and ethics and draft appeal briefs. Coordinate, supervise and lead the handling of appeals on behalf of the Prosecutor before the Appeals Chamber; Appear before the Appeals Chamber as a lead counsel for the Prosecutor.

Work implies frequent interaction with the following: The Prosecutor, Deputy Prosecutor, Chief of ALAD, Chief of Prosecution, Trial Attorneys, staff of ALAD at all levels, Appeals Chambers Judges, defence lawyers.

Education

Advanced Law Degree from a University of recognized standing. Advanced studies in International Criminal Law or International Humanitarian law and relevant advocacy experience before international and national jurisdictions may be accepted in lieu of an Advanced Law Degree

Work Experience

A minimum of 7 years of relevant practical legal experience is required. Advocacy experience as a trial or an appellate advocate in the field of international criminal law is required. The candidate must be of good professional standing, with no disciplinary record relating to unprofessional or unethical conduct

Languages

English and French are the working languages of the International Criminal Tribunal for Rwanda (ICTR). For the post advertised, fluency in spoken and written English or French is required and a good working knowledge of the other is highly desirable.
