GENERAL OBJECTIVE: ASMED will field a Build Own Operate (BOO) Specialist, who will assist TAFA with designing a workable framework for implementation of a Public-Private Partnership within the legal framework of Afghanistan. Assisted by a local lawyer familiar with Afghanistan's law on procurement and other relevant legislation, the specialist will assist TAFA in the development of tender documents for the Hayraton concession and in the drafting of a model contract or agreement between GIRoA and one or more private sector investors which will serve as the primary agreement for implementation of the PPP. BACKGROUND AND JUSTIFICATION: Hayraton is a border crossing town between northern Afghanistan and Uzbekistan, and is a rail terminal and large transportation hub for goods coming from the former Soviet Republics and Europe. It is the primary northern port for importation of consumer goods, construction materials, foodstuffs, petroleum products and ISAF materials. As a result, Hayraton plays an important economic role for Afghanistan. The Hayraton hub is an example of inefficiency in action: there exists none of the infrastructure expected for such an integral trading venue. There are no staging areas, parking lots, nor cranes for loading and unloading of containers. Large scale companies have private terminals and other infrastructure on their own compounds, and small and medium enterprises (SMEs) are forced to rely entirely on the large scale companies for services. Due to the lack of basic infrastructure, hundreds of trucks sit on the road sides every day waiting to load or unload goods. Lack of adequate controlled parking spaces for commercial freight trucks force tractor/trailers, flat beds and fuel carriers to line Hayraton main street from the first police checkpoint to the port entrance, both on and off the road, blocking thru traffic and creating a hazardous environment. Exhaust of waiting trucks fills the air with pollutants and welding torches and power tools are used next to trucks, leading to the possibility of accidents catastrophic proportions with tanker trucks and fuel storage tanks nearby, not unlike similar tragedies at truck parks in Pakistan. The environmental hazards found in Hayraton can be greatly relieved by the development of a designated trucking services and parking area with no cost the community, while also providing an opportunity to introduce a model for future Private Partner Partnerships (PPP) between investors and GIRoA entities. USAID's TAFA project (Trade Accession Facilitation for Afghanistan) is working on facilitating the development of a PPP model to promote private sector investment in and operation of appropriate transport facilities at Hayraton to improve efficiencies, increase safety, and expedite freight forwarding. ASMED will support TAFA's efforts by undertaking a series of short term technical assistance engagements for this effort. A similar situation exists in Islam Qala, in Herat province. TAFA has requested ASMED's assistance in undertaking a site survey in Islam Qala to determine the feasibility of a similar activity in Herat. RATIONALE: The environmental hazards found in Hayraton can be greatly relieved by the development of a designated trucking services and parking area with no cost the community, while also providing an opportunity to introduce a model for future Private Partner Partnerships (PPP) between investors and GIRoA entities. PPPs would provide an opportunity for cooperation between private businesses and GIRoA entities, where both sides have an opportunity to prosper; the investor in terms of economic gain and the Afghanistan government and people with a solution to a potentially hazardous situation that its not currently in the position to address on its own. For the Hayraton terminal, private business could develop, build, maintain and operate the trucking services and parking area for a contracted period, while the current traffic and accompanying hazards would be reduced, as well as making the transport process more efficient. DETAILED RESPONSIBILITIES: The BOO Specialist will assist TAFA with designing a workable framework for implementation of a Public-Private Partnership within the legal framework of Afghanistan. Assisted by a local lawyer familiar with Afghanistan's law on procurement and other relevant legislation, the specialist assist TAFA in the development of tender documents for the Hayraton concession in order to attract private investment and management of truck parking and service facilities. The specialist will also advise in choosing models for and drafting a model contract or agreement between GIRoA and one or more private sector investors which will serve as the primary agreement for implementation of the PPP. OUPUTS AND DELIVERABLES: 1. Serve as the team leader in developing draft concession and contract models with the support of a local lawyer. The process should be conducted in consultation with TAFA and the draft documents shared with the Transit Trade Facilitation Department and MOCI. 2. Recommendations and draft of a sample PPP contract. 3. Organize up to two training sessions for Trade and Transit Facilitation Department (TTFD) | |
Basic Qualifications: | |
QUALIFICATIONS: Master's degree or equivalent experience in a PPP related field (business, public policy, economics) At least 10 years experience in the development and promotion of public-private partnerships Specific experience in the development of tender documents, concession agreements, and other legal documents for PPPs Familiarity with a wide range of PPP models, preferably related to the freight and transport sector | |
