International Parliamentary Expert

Myanmar is at an historic stage in its development. A new Constitution was adopted in May 2008 and elections were held in November 2010 with bi-elections in April 2012. Parliament and governments have been formed at the national and region/state levels. A number of reforms have already been undertaken focusing on good governance, human rights and reaching cease-fire agreements in a number of conflict areas. These reforms are seen as positive steps, which have led to increasing engagement with the international community and allowed Executive Board of UNDP to lift mandate restrictions and to propose a fully-fledged UNDP country programme.
 
Against this rapidly changing background, UNDP Myanmar is undergoing strategic repositioning and ramping up its capacities in order to effectively support national priorities of democratic transformation and poverty reduction. After more than 20 years of working exclusively at the grassroots level through the Human Development Initiative, the draft country programme for Myanmar (2013-2015) envisages contributions towards strengthening democratic governance, provision of policy advice for poverty reduction, strengthening resilience against climate change and disaster risk reduction, and targeted support for strengthening institutions of local governance.
 
On 31 January 2011, the newly elected parliament in Myanmar was convened for the first time. This effectively restored the country's parliament, which had not functioned since its dissolution in September 1988. As a result of the Constitution of 2008, Myanmar has two houses of parliaments – national and regional/state. At the national level the Parliament, known as the Pyidaungsu Hluttaw, consists of two chambers – the Piythu Hluttaw (440 seats) and the Amyotha Hluttaw (224 seats). The Constitution provides for the direct election of 75% of the members of both Houses with the remaining 25% being appointed by the military.
 
During the short time it has been in operation, the Union Parliament has made progress in moving forward a very full legislative schedule, and adopting standing orders and basic procedures. The passage of legislation is seen by all parties as a priority for the national parliament. Many laws in the country date back to colonial times and there is broad agreement that the legal code of the country must be updated. However, new systems need to be developed for the elected membership and the Secretariat including rules of procedure and codes of conduct, committee structures strengthened, and capacities improved in all areas of parliamentary operations and management.
At the regional/state level, there is one unicameral parliament for each of the seven states and seven regions within Myanmar for a total of 14 parliaments and the relationship between the regional parliaments and the national parliament continues to evolve. Noting the Government’s stated commitment to decentralization over time, and the important peace-building role that sub-national legislatures can play in the complex, multi-cultural context of Myanmar, it is imperative that support is provided to strengthen the capacity of sub-national MPs to effectively provide parliamentary functions to their states.
 
In this context, Pillar 3 of the country programme addresses support to democratic governance, with four outputs including in particular an output on Parliamentary Support as follows:
  • Improved capacity of MPs, with special focus on women, at the Union and State/Region levels to perform their functions in an effective, transparent and inclusive way.
  • Enhanced institutional capacity of key parliamentary committees at the Union and State/Region levels to ensure the parliament is able to pass quality legislation including consideration to gender responsiveness, marginalized groups, people living with and affected by HIV and disabilities and oversee government activities.
  • Improved capacity of parliaments to effectively communicate for internal and external purposes.
  • Enhanced capacity of the Union parliamentary secretariats at the Union and State/Region levels to provide effective and gender responsive support to MPs, committees and the respective parliaments.
  • Civil society and media more aware and empowered to participate in democratic political processes.

Duties and Responsibilities

The Consultant will provide technical and strategic support to the Parliamentary Service and the UNDP Parliamentary Support Project. The Consultant will be tasked with analyzing and formulating recommendations to enhance the policies and procedures of the Parliamentary Service. The incumbent will assist in providing management oversight of other advisors contracted by the project. The Consultant will work in close consultation with the Programme Specialist on all matters of day-to-day project implementation.
Under the overall guidance of the Project Advisory Committee (PAC) and under the direct supervision of the Team Leader of the Democratic Governance Programme or delegated UNDP senior officer, the Consultant will in general undertake the following duties and responsibilities for efficient implementation and management of the project:
  • Further strengthen the relations with the parliament and support the strategic direction of the parliamentary support project;
  • Provide technical advice on parliamentary functions and processes;
  • Provide advice on the capacity development of staff of the Parliamentary Service;
  • Provide technical guidance and support to project personnel and consultants;
  • Assist in the preparation of the annual work plan, biannual reviews and terminal reports in compliance with UNDP procedures;
  • Implementation of Parliamentary Support Program Strategies;
  • Monitoring and analysis of the program environment, timely readjustment in portfolio;
  • Assist in strategic planning for sections of the Parliamentary Service;
  • Provide advice to the Project Manager in the drafting of activity work plans;
  • Provide direct assistance to counterparts for supporting Parliamentary Services;
  • Participate in the project evaluation and monitoring exercises;
  • Develop a comprehensive review report on capacity development of Parliamentary Services;
  • Network with regional Parliaments and governments, in order to identify opportunities for study tours and on-the-job training programs for the staff of the Parliamentary Service;
  • Network with regional and international entities engaged in parliamentary development, including the UNDP Regional Centre in Bangkok and UNDP DGG office.
  • Disseminate the information, findings of reviews and project activities through the media and the UNDP Web site;
  • Assist the project manager in managing of project staff and/or activities upon request
  • Any other task or duty assigned by the supervisor
More specifically, the Consultant will prepare and start project implementation of the following outputs of the results framework of the parliamentary support project:
    • Parliamentary development plan (PDP);
    • Capacity development activites for MPs in the Union Parliament;
    • Technical support on financial management is provided to Public Accounts Committees of the Amyotha Hluttaw and the Pyithu Hluttaw;
    • Technical support provided to the Human Rights and Democracy Committees, the Women and Children Protection Committees and the Population and Social Development Committees of the Amyotha Hluttaw and the Pyithu Hluttaw;
    • Union Parliament communication plan;
    • Advice and support for establishing and maintain an International Relations Office and preparation for capacity building activities;
    • Supporting engagement between the parliament and civil society organizations to provide feedback on public perceptions and present to relevant committees.
    • Close liaison with other projects under the democratic governance and local governance pillars of the UNDP programme for Myanmar;
    • Close liaison and coordination with other UN agencies and development partners;
    • Support the development of a network between sub-national parliaments and further assist in building linkage for the purpose of supporting knowledge sharing between the Union Parliament and sub-national parliaments.
      EXPECTED OUTCOME:
      • Implementation of the key activities of the parliamentary support programme initiated in full coordination with parliament and other relevant stakeholders.
      EXPECTED OUTPUTS:
      As part of the assignment the incumbent are responsible for:
      • Baseline, indicators and activities of the parliamentary support programme conformed;
      • Agreement among the parliament and relevant development partners and other international organization on a process for developing a Development Plan for the parliament which identifies needs and resources;
      • Improved capacity among relevant staff and parliamentarians in areas where capacity building activities has been initiated as according to the Annual Work Plan;
      • Improved knowledge and information available for how to use various forms of communication in strengthening the work of the parliament on key issues;
      • Plan for the establishment and maintenance of an International Relations Office;
      • Improved understanding of the role and relations between the parliament and civil society;
      • Access to capacity building activities for state/regional parliaments through the Parliamentary Union of Myanmar.
      DELIVERABLES:
        Coordinate at least 3 workshops and seminars on following issues as identified in the 2013 Annual Work Plan and in coordination with other UN agencies and development partners:
          • General capacity development of MPs on issues such as function and procedures of the parliament;
          • Capacity building on development and human rights issues;
          • Gender budgeting.
            Development Plan developed and agreed between parliament, relevant development partners and international organizations;
              • Organize consultation meetings between relevant stakeholders with a view to developing an overall assistance framework for the parliament.
                Identify activities for supporting the Union Parliament and state/regional parliaments in relation to capacity building and technical support through the Parliamentary Union of Myanmar;
                  • Identify a workshop in coordination with the Parliamentary Union of Myanmar in order to support the sub-national parliaments through the Parliamentary Union of Myanmar.
                    Prepare and implement activities for supporting the development, initiation, capacity building and maintenance of an international relations office within the parliament;
                      • Identify and prepare a plan for twinning the international relations office with another parliament;
                      • Prepare and organize workshop on parliamentary protocol;
                      • Prepare a plan for relevant training for general capacity building of relevant staff.
                      • Prepare and organize 1 study visit;
                        Plan capacity building activities for fostering engagement between the parliament, civil society and academia:
                          • Organize workshops on consultation on relevant issues;
                          • Organize preliminary and separate seminars on consultation with civil society and the parliament.
                            Plan for further capacity building and activities developed in supporting the development of a communication plan for the parliament:
                              • Organize one workshop on sharing information and examples on best practices on use of communication from other parliaments.
                                Annual Work Plan for 2014 developed in coordination with the parliament.
                                  INSTITUTIONAL ARRANGEMENT
                                  The consultant will be reporting to the Team Leader of the Democratic Governance Unit who will be responsible for approving the deliverables and will work closely with the Programme Specialist.

                                  Required Skills and Experience

                                  Education:
                                  • Advanced university degree in law, social sciences, International development, Economics, law, human rights, peace studies
                                  Experience:
                                  • 10 years of increasingly responsible relevant professional experience, including experience in parliamentary development or in a parliament;
                                  • Knowledge of law making, including relevant international human rights standards;
                                  • Experience in development and conduct of training for parliamentarians;
                                  • Prior experience in the UN system is an added advantage.
                                  Language Requirements:
                                  • Full working knowledge of English, including excellent writing skills.
