I. Access to Justice Capacity-Building for Civil Society
Pact is supporting increased access to justice in South Sudan as part of its overall access to justice and peacebuilding portfolio through the South Sudan Peace Fund. Pact’s access to justice programming focuses on increased access to justiceat the State and County-level in South Sudan through funding and technical assistance to government, traditional authorities, civil society, communities and individual clients. Pact’s access to justice program seeks to expand government and traditional authorities’ justice service delivery capacity, strengthen civil society’s capacity advocate for and provide justice services, and increase individual citizens’ understanding of their fundamental rights and access to legal services.
After decades of war, civil society’s capacity to advocate for and provide justice services in South Sudan is understandably low. Apart from a few successfulEquatorias-based organizations engaged in a wide-range of justice sector activities, South Sudan has seen little civil society organizations or activities dedicated to access to justice. Civil society organizations regularly cite the need for accessible justice services, especially for the poor, and the need to improve rule of law as a key element of building a peaceful South Sudan. However, little has been done so far to provide civil society with the tools they need to be a key link between citizens and the government
Pact’s access to justice program will support organizations working in areas that are “donor orphans” in the areas of civil society promotion of access to justice and rule of law. Program selection criteria include:
i. Urgency of the need for access to justice programming in a particular area;
ii. Lack of civil society access to justice programming in a particular area;
iii. Desire by a particular civil society organization with the internal organizational capacity to engage in access to justice programing in an ethical manner;
iv. Potential for Pact or other donors to support an organization’s access to justice programing once an organization has developed requisite skill sets, concept notes, and proposals.
II. Civil Society Access to Justice Capacity-Building Consultant
The Civil Society Access to Justice Capacity-Building Consultant will begin work in Greater Upper Nile. Greater Upper Nile was selected asto pilot the civil society capacity building program. Government provision of legal servicesand the physical presence of the justice sectorare lower in Greater Upper Nile than in any other area. At the same time, in addition to the justice sector challenges present throughout South Sudan, myriad militia groups are operational in the area and destructive cattle raiding has killed or displaced thousands so far this year.The vast majority of Greater Upper Nile is a remote andchallenging environment. Supporting civil society’s efforts to improve citizen access to justicein Greater Upper Nile will demonstrate that civil society in South Sudan can play a key role in access to justiceand will increase South Sudanese’s enjoyment of their constitutional rights.
III. Specific Tasks
The Consultant’s role is to provide direct capacity building services in support of Pact’s Access to Justice Program. Specifically, the consultant shall undertake the following upon request from Pact:
1. Civil Society Capacity Building and Mentorship
• The Consultant will provide training for CSOs on South Sudanese law and other basic legal principles;
• The Consultant will train CSOs on different models of access to justice programming with CSOs such as: paralegal programs, Legal Aid clinics, strategic litigation, mediation services, community awareness raising, and policy and advocacy at local, state, and national levels;
• The Consultant will work with CSOs to understand the institutional requirements of different types of access to justice programming;
• The Consultant will provide training on ethical provision of Legal/Paralegal Aid or other types of access to justice programming and on how to maintain confidentiality of client records and personal information;
• The Consultant will work with partners to develop concept notes and proposals for access to justice programming;
• The Consultant will provide ongoing support, which may include training and guidance to CSOs during the implementation of access to justice programming.
2. Access to Justice Program Support
The Consultant may, at Pact’s request and the Consultant’s discretion, provide expert informationon access to justice programming and best practices. This may be information provided in support of policy papers or advocacy material, presentations to various audiences, or meetings with partners or other stakeholders.
IV. Deliverables
1. Trainings Provided:
o South Sudanese Law and Legal Principles;
o Ethical Provision of Access to Justice Services;
o Different Methodologies and Structures of Access to Justice Programming;
o Organizational Administration and Financial Structures;
o Other Trainings, as Necessary
2. Support for Program Design
o Assistance to Civil Society Organizations in Developing Programming and Organizational Structures to Support Access to Justice Programming;
o Concept Notes, Proposals, and Budgets Prepared by Civil Society Organizations
3. Access to Justice Program Support, Provided upon Request by Pact:
o Written Reports on Inquires Related to Access to Justice Programming and Best Practices;
o Meetings and other Verbal Briefings
4. Invoices detailing Work during Invoice Period:
o Invoices submitted to Pact every two weeks;
o Invoices specifying work undertaken by the Consultant for each day of work during the invoice period. (For example, trainings developed and provided,proposals supported, mentorship activities, etc.)
o Invoices specifying the estimated end date of the contract
V. Ideal Candidate
The Consultant should have:
• Experience working in civil society organizations promoting access to justice and the rule of law in conflict impacted areas;
• Sound understanding of different access to justice strategies;
• Experience managing or developing civil society organizations;
• Demonstrated commitment to access to justice and human rights;
• Sound judgment and a strong sense of ethics;
• Ability to travel frequently through remote regions of Greater Upper Nile;
• Experience in Sudan or South Sudan;
• Ability to speak Arabic or languages spoken in Greater Upper Nile.
